Order processing procedure in NFA
Here you can get acquainted with basic essentials and rules at the order processing procedure in NFA. Due to the big variability of requests addressed to NFA it is not possible to give here a complete enumeration of answers to questions pertaining to providing of NFA materials. The below -mentioned text will serve you as initial information, we will be happy to answer any particular question on the mentioned telephone numbers or by e-mail. - ORDER
- NFA services performed in connection with processing the request on provision of NFA materials (retrievals, film copies handling, selected projections etc.) are paid. By accepting an order, the customer is obliged to pay for the performed deeds and services in accordance with the NFA Price list, even in the case the order is not realized eventually.
- The order shall contain:
- Customer’s invoice data (Identification No, address)
- The subject of your request, i.e. what material do you request from us (particular film title or themes that are to be the subject of retrieval in our collections)
- The purpose of your request, i.e. for which particular purpose you are going to use the requested material. This information is important for further negotiation and setting the license conditions.
- Current contacts (telephone, e-mail) - The order may be sent by e-mail, fax or by ordinary mail.
- RETRIEVALS
- We will hand over your order to NFA film historians and custodians of collections who will carry out retrieval, i.e. they will find out whether we have the requested material in our collections and its technical availability.
The order for retrieval is a particular film title or theme, i.e. description of what materials you are looking for. The theme for retrieval can be almost anything – personality, place, story, a historical event etc. - The retrieval fee amounts to CZK 260/hour (retrieval of ordered title) or CZK 450/hour (retrieval of ordered theme).
- We will inform you about the retrieval result by phone or e-mail and, if you are interested, we will agree upon viewing the materials (selection projection), license conditions and further procedure.
- SELECTION PROJECTION
The selection projection or projection of entire films takes place in the technical department premises Malešická 12, Prague 3. - The date of the projection is to be agreed upon about one week in advance in order to reserve the premises and to provide the transportation of the materials- the materials are transported from a deposit outside of Prague twice a week, always on Tuesday and Friday.
- You can see and choose the NFA archive film materials and choose in two ways, depending on technical availability:
1. In video projection from the VHS or DVD carriers with time code in picture
2. In the event we have the requested material only on a film copy, you will select it under the assistance of the NFA technical department worker by the paper method on the editing table. - The fees for services related to the selection of material in the NFA premises (film copies handling, use of video production, use of the editing table...) you will find in the valid NFA Price list.
- PRICE LIST AND LICENSE RATES
- Technical cost:
You can learn the fee amount for services related to the provision of NFA materials in the NFA Price list. The price for transcription of materials is set by an external transcript studio – see the paragraph "transcription" below. - License rates:
When setting the prices for provision of rights or approval to use the NFA materials, the data about the way of disseminating the materials or the work in which the materials are used, are decisive, i.e.: the requested type of rights (TV, DVD, cinema-distribution, one-time public projections, use at an exhibition etc.), territory, cost and price of a copy, the time extent of the required license, number of repeated performances, broadcasting, projections etc.
Please mention in your order all relevant information, a brief description of the project and especially, be specific. Formulation "Requested type of rights: non- commercial use." is not a sufficient information to set a license rate.
At the hiring of film copies for projection, there is set a percentage deduction from the collected admission charge, with a minimal fixed payment- see the NFA Price list. - Re.: NFA logo in picture:
In the event we provide materials for non-professional use for decreased lump rates (for instance, rough editing of materials for presentation at the exhibitions, one-time projections of entire films from non-film carriers, study use etc.), we provide the particular material with a copied in NFA logo in the corner of the picture.
- COPYRIGHTS
Under the Copyright Act and related rights, the copyrights of the authors of an audio-visual work are extended to 70 years after the death of the last author of the work – for more information see the Copyright Act (No. 121/2000 Coll.). - The legal duty to settle proprietary copyrights to the work and obtaining an approval of the authors of the work or their heirs for the use of the work is on the part of the customer since NFA does not dispose of the mentioned rights and it cannot provide them.
- In this matter, please, address the medial department of DILIA – Theatre, Literature and Audio - Visual agency - www.dilia.cz or as the case may be other collective administrators of copyrights (OSA, Intergram).
- The obligation to settle the copyrights and related rights is one of the points of the License Agreement being concluded between the customer and NFA.
- AGREEMENT
- Entering into an agreement in which license and financial conditions are set is the condition for the provision of NFA materials.
- If it is provision of materials exclusively for study purposes, i.e., without license for any use, the customer shall sign declaration on word of honour.
- We send the proposal of an agreement made based on written, telephone or personal negotiation about license conditions usually electronically to the customer’s contact e-mail address.
- Before the agreement is entered into, only a preview working material can be provided based on a proper order (on carriers provided with a copied- in time code in picture).
- The necessity to enter into the agreement does not relate to the cases when the material is viewed in the NFA premises from study purposes, based on a proper order.
- TRANSCRIPTION
- We order transcription of material onto the final carrier (in the master quality) solely after the conclusion of the license agreement.
- NFA does not dispose of an own transcription workplace; we transcript the materials in external transcript studios, therefore take into account a certain time interval (about 1 week) needed for technical and logistical provision of the transcription.
The financial and time demand depends on the type and amount of the transcripted material. - We will inform you about the organizational details and an approximate price of the transcription (the prices are determined by the transcript studio price list) based on a particular order and the retrieval result in the NFA collections.
- If interested, the material can be transcripted onto the own carriers supplied by the customer.
- TAKING OVER OF MATERIAL
As standard, we send the carrier made by mail or by the courier service at the customer’s cost or it is possible to pick it up personally in our office in Malešická 12. - We don’t send materials by the cash on delivery shipment!
- PAYMENT
We send invoice by mail to the address mentioned in the agreement or the declaration on word of honour (if your invoice address differs from the seat of the company, mention these data in the order). - The technical cost that arise in connection with processing of your request (film copies handling, selected projections, transcription onto preview work carriers etc.) are invoiced continually, i.e. in the case of long-term projects when the customer works off-line with preview carriers, still before the signature of the license agreement.
